The POA Board held a Special Meeting on June 16th for Association members to vote on two important amendments to our Declaration of Covenants. A quorum was not achieved, so the meeting was continued and will reconvene on December 14th at 6 p.m..  If you have not voted and would like to vote, you can simply take a picture of the signature pages and send those to foundersbridge@gmail.com or you can scan the signed forms and email those to the same address.

The first amendment provides for a capital contribution for buyers of existing homes in Founders Bridge.  Original buyers have always paid a capital contribution.  The Board now recommends that we charge a capital contribution to buyers on resales. 

The second amendment allows the Board to set and enforce standards for solar panels that may be installed in our neighborhood.  The standards would be managed by the Board through the Architecture Review Committee.  The need for this amendment is driven by a new Virginia State Law. 

We need 272 votes for these proposed amendments to be approved. We currently have 254 votes. You actually would complete 2 proxies since you own 2 lots. 

We have attached proxy documents you can use to allow the Board Treasurer to exercise your vote, with or without providing specific guidance on how to vote.  Unless you provide other guidance, the Treasurer will vote FOR the amendments.  If you prepare to vote in person, you may appear at the next scheduled Board meeting.

Amendment 1: Collect Capital Contribution on Resales

The purpose of this proposed amendment to the Declaration is to establish a new capital contribution requirement for people who buy homes from existing residents (resales).  This change was recommended during the updated reserve study conducted last summer as a means to increase funding for growing maintenance and repair costs in Founders Bridge.  If approved, this amendment will implement a capital contribution from buyers of resales equal to ½ the annual POA dues at the time the sale is completed (($720 for 2020). 

Founders Bridge is now more than 20 years old, and we are seeing rising costs to repair walking trails, sidewalks, irrigation, the tennis courts and more.  Our previous capital reserve analyses underestimated these costs, and this is part of the solution to help keep dues from increasing more rapidly.  

Some other Communities in our area that collect the capital contribution are Brandermill and Magnolia Green.

The Board recommends you vote to approve this proposed amendment.   

Amendment 2: Prohibit Installation of Solar Panels Without ARC Approval

The purpose of this proposed amendment to the Declaration is to allow the Association to control future use of solar panels within Founders Bridge.  Recent legislation passed by the General Assembly and signed into law by the Governor on or about April 7, 2020 severely limits such control to actions that do not decrease the power collected by more than 10% and do not increase implementation cost by  more than 10%, unless the declaration explicitly provides such power to the Association. 

As use of solar power grows in popularity, many different types of collectors will enter the market.  The Association wishes to continue to require review and approval by the Architecture Review Committee (ARC) before any such devices are installed.  This review is intended to ensure the appearance of modifications meet the principles of scale, proportion, balance, rhythm, and order as documented in the Architecture Review Guide, which is available on the property owners’ website. 

The Board recommends you vote to approve this proposed amendment.
